Team of KM Partners lawyers successfully protected the client’s interests against a lawsuit claiming the mortgage agreement void and reclaiming real estate estimated more than USD 10 million. KM Partners’ lawyers achieved the unique court decision on the plaintiff’s obligation to make a deposit in the amount of approximately UAH 380,000.00, to ensure the defendant’s expenses for professional legal assistance.
This decision is one of the first precedents in Ukraine of the effective use of the new legislation on commercial proceedings against groundless claims submitted by the person without any property in Ukraine. Due to the fail of the plaintiff to fulfill the court’s writ and make a deposit, his claim was left without consideration. In addition, we obtained a court decision on the compensation of more than UAH 100,000.00 for client’s expenses for professional legal assistance.
