Maxim Oleksiyuk delivered a report on right of access to berths

MO_On October 19-21, 2016, there was the International Black Sea Transport Forum 2016 in Odessa, within the frame of which the 19th international conference “Development of the transport services market in Ukraine in the context of integration into the European and international transport systems” was held.

Maxim Oleksiyuk, partner of KM Partners, who leads the company’s legal practice of construction and infrastructure, presented the report “Guaranteed access to berth is the necessary condition for investment in the port”.

Maxim underlined that it is important to establish clear rules for formalizing right of access to berths as the necessary condition for attracting investment in the port. The currently available mechanisms of access to berths cause significant inequality among the port operating companies, when their commercial and legal positions are compared. The report was focused on analysis of existing regimes of access to berth, including on conditions of the special service, concession, lease, servitude, as well as private or shared property.
