The Partners Alexander Minin and Alexander Shemiatkin participated in the First In-House Counsel Forum which took place on October 17, 2013 in Kiev. The event was organized by “Yuridicheskaya Praktika” publishing house. The purpose of the Forum was to discuss the topical issues, which legal advisers are facing in their work, as well as to reward the winners of the ’50 leading legal departments of Ukraine’ ranking research, which was initiated by “Yuridicheskaya Praktika”.
The Forum combined different subject sessions: “Management”, “Court practice”, “Tax law”, “Protection of economic competition”, “nternational arbitration”, “Criminal and legal risks of doing business” and “Capital markets”. The reports of the Partners of the KM Partners law firm were presented in “Tax law” and “Criminal and legal risks of doing business” sessions. In particular, Alexander Minin presented a report “Transfer Prices: Getting Ready for Disputes?” in which he analyzed specialties of application of legal novelties in the field of transfer pricing in practice (“Tax law'”session). The speaker focused attention on increasing administrative pressure on taxpayers and increasing amount of disputes regarding operations which are considered to be controlled according to the Law “On Amendments to the Tax Code of Ukraine on transfer pricing”.
The report of Alexander Shemiatkin “Tax Dispute vs. Crime?” was presented in the second session “Criminal and legal risks of doing business”. Reviewing aspects of qualification of tax evasion Alexander drew attention to subjective and objective sides of qualification of such offences as well as peculiarities of criminal proceedings in tax disputes. On the speaker’s opinion the new Criminal Procedural Code of Ukraine and Article 212 of the Criminal Code of Ukraine contain a number of internal collisions and need further clarifications and amendments.
